Registering your Lasting Powers of Attorney

Before a Lasting Power of Attorney (LPA) can be used, it must be registered with the Office of the Public Guardian (OPG). The OPG is a government body responsible for overseeing LPAs and protecting people who lack the mental capacity to make their own decisions.

Why registration is important?

An LPA is not legally valid until it has been registered. This means your chosen attorneys cannot act on your behalf until the registration is complete. The process usually takes around 8 to 12 weeks, so it is wise to register your LPA as soon as it has been signed. That way, it is ready if and when it is needed, particularly in the event of a sudden illness or accident.

The role of the OPG

The Office of the Public Guardian helps safeguard individuals who are no longer able to make decisions for themselves. It is responsible for:

Registering LPAs and checking for any errors

Keeping official records of all registered documents

Investigating concerns about how an attorney is acting
